Contest Theme: Submit an audio clip (30 seconds or less) of you singing the Chock full o' Nuts Jingle. 40 Finalists will be determined by judges and will be posted online for America to vote for their favorites. America's votes will determine 1 grand prize winner who will record a Chock full o' Nuts radio commercial and receive $75,000.

  1. SPONSOR: SPONSOR: The Sponsor of the Chock full o' Nuts Singer Wanted Contest ("Contest") is Massimo Zanetti Beverage, USA ("Sponsor"), 411 Theodore Fremd Blvd, 2nd Flr-Suite 206, Rye, NY 10580.
  2. ELIGIBILITY: Contest open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who are 18 or older at time of entry. The Contest is void outside this specific area and where prohibited. Employees of Sponsor, its parent, affiliated companies, and its promotional, advertising, judging organization and public relations agencies and their subsidiaries, agents and the families or those living in the same household of each are not eligible to enter or win, nor are entrants who, as of 1/29/07, are professional or former professional performers or who have had their work previously published, or who have signed or been bound by a recording or similar contract with a record company or other third party who represents more than one artist or group. The decision as to whether or not an entrant is/was a professional performer will be within the sole and reasonable discretion of the Sponsor and independent judging agency. Furthermore, any entrant who has ever been convicted of a felony will not be eligible.
  3. LIMITATIONS OF LIABILITY: The following promotion is intended for viewing in the United States only and shall only be construed and evaluated according to United States law. Sponsor, Circle One Marketing, their respective parents, subsidiaries, divisions, affiliates, distributors, suppliers and advertising, promotional or judging agencies, their respective parent companies, affiliates, subsidiaries, agencies and the employees, officers, directors and shareholders of each, is not responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages arising out of your participation in this Contest, access to and use of the Website or the downloading from and/or printing material downloaded from www.chockfullonuts.com (the "Website"). Without limiting the foregoing, everything on this Website and in this Contest is provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or noninfringement.     VIA EMAIL: Go to chockfullonuts.com beginning at 12:00:01 AM ET on 1/29/07, click on the Contest icon to enter the promotional site, click on the SING button and follow the instructions to complete the Official Entry Form. You will need to fill out your name, address, phone number, date of birth, and email address, although email address is not necessarily required to enter. To enter the Contest, your computer must accept cookies, or any successor or similar technology (whether now known or hereafter devised or discovered), which may be used by Sponsor for the purpose of tracking entries into the Contest. Once you fill out the Official Entry Form, you will receive a unique user ID number. This number must accompany each entry that you submit. In order to submit your entry, follow instructions via the SUBMIT button to email an audio clip of yourself (up to 30 seconds in length) singing the Chock full o' Nuts jingle by 11:59:59 PM ET on 3/15/07 to: singerwanted@chockfullonuts.com. IF THE PERFORMANCE IS LONGER THAN 30 SECONDS, ONLY THE FIRST 30 SECONDS WILL BE JUDGED. Your file must be named using your ID number and the date that you are emailing the file (IDNUMBER_MonthDay.mp3). The subject line of your email should be titled the same way your audio file is labeled (IDNUMBER_MonthDay). You may enter more than once, however, only one entry may be submitted per email address, per day, and each entry must be different. Only one finalist spot per entrant, regardless of the number of entries submitted.

Entries must be received by 3/1/07. YOUR AUDIO CLIP MUST BE SUBMITTED IN A CD THAT WILL PLAY IN A STANDARD CD PLAYER OR COMPUTER. IF THE PERFORMANCE IS LONGER THAN 30 SECONDS, ONLY THE FIRST 30 SECONDS WILL BE JUDGED. Your file must be named using your ID number and the date that you are mailing the file (IDNUMBER_MonthDay.mp3) and you must label the outside of the disk/CD with the same name. You may submit multiple entries, however, EACH ENTRY MUST BE DIFFERENT AND MAILED SEPARATELY and must be labeled appropriately with your ID number and the date. Limit one entry per outer mailing envelope. Not responsible for lost, late, mutilated/damaged, postage due or misdirected mail or for entries damaged during judging.

    All entrants for all methods of entry must use the actual words and general melody of the selected jingle but may change key and/or tempo. Lyrics are available at chockfullonuts.com. Entrants can be a solo artist or a group.

    Entries become the sole property of Sponsor and none will be returned. No correspondence will be acknowledged or entered into. All entries may be used by Sponsor for advertising, marketing and promotional purposes. Failure to comply with any entry requirements or any other Official Rules will result in disqualification.
  5. FINALIST JUDGING: All eligible entries will be judged by the sponsor to determine the top 40 entries to be posted online at chockfullonuts.com. Judging will be based on the following criteria: Overall Performance (50%), Style and Creativity (30%) and Suitability to be in a Chock full o' Nuts radio commercial (20%). In the event of a tie at any level of judging, tied entries will be re-scored on the basis of Overall Performance by an additional judge. Sponsor reserves the right to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the promotion or any other person or entity.
  6. WINNER DETERMINATION/CONSUMER VOTING: 40 Finalists will be determined by judges and will be posted online for America to vote for their favorite. The consumer voting will be conducted over the course of five weeks, four weeks will be to determine four Finalists (one finalist to be chosen per week) and one week will be to determine the grand prize winner (from the pool of 4 Finalists). Each week will last from Sunday at 12:00:01 AM ET through Saturday at 11:59:59 PM ET. For the first four weeks (3/4/07 - 3/31/07), the audio entry with the most votes will move on to the final week of voting. For the final week (4/1/07 - 4/7/07), the entry that receives the most votes will be deemed the Grand Prize Winner. There is one way to vote:

    Beginning 12:00:01 AM ET on 3/4/07 through 11:59:59 PM ET on 3/31/07, the top 40 Finalist entries will be posted online at chockfullonuts.com, with 10 different Finalists posted each week of the period. Website visitors will be given the opportunity to vote for their favorite entries online (detailed voting instructions will be available at the website). Voting open to all ages. Limit one online vote per registered user, per day. If more than one online vote is received per person per day, only the first online vote received will be eligible. Massimo Zanetti Beverage USA, its respective parents, subsidiaries, divisions, affiliates, distributors, suppliers and advertising, promotional or judging agencies, and the employees, officers, directors and shareholders of each (collectively, "Releasees") are not responsible for technical failures in voting transmission. If a voter uses multiple email addresses to submit more than one vote for a given day, only the first online vote for that day will count. Voters may not enter with multiple identities, nor may voters use any other device or artifice to obtain more than the maximum number of votes. Any voter who attempts to participate with multiple identities or uses any device or artifice to obtain more than the maximum number of votes may be disqualified. Sponsor is not responsible for lost, late, misdirected, or incomplete votes. By voting, you agree to these Official Rules and that the decisions of Sponsor are final and binding in all respects. All votes become the property of Sponsor and will not be returned or acknowledged. Sponsor assumes no responsibility for votes that are corrupted or otherwise not received correctly, or for any telephone network or lines, computer system, hardware, software, or program malfunctions, or other errors, failures, or delayed computer transactions or network connections that are human or technical in nature. Sponsor assumes no responsibility for any incorrect or inaccurate capture of information, whether caused by website users, tampering or hacking, or by any of the equipment or programming associated with or used in the Contest. Sponsor assumes no responsibility for technical problems or traffic congestion on the Internet or at any website or combination thereof, including damage or injury to any participant's or to any other person's computer related to or resulting from participating or downloading materials in the Contest. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the voting process or the operation of the Contest or the Website; to be in violation of the Terms of Service of the Website; to be acting in violation of the Official Rules; to be acting in a nonsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person. Any use of robotic, automatic, macro, programmed or like voting methods will void all such entries by such methods, and persons using any such methods will be disqualified. In the event that the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to terminate, modify, or suspend this Contest award the Prizes using all eligible votes received as of the termination date. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CIVIL AND CRIMINAL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM THOSE RESPONSIBLE TO THE FULLEST EXTENT PERMITTED BY LAW.

    At the end of the initial voting period, the four entries with the most votes (1 per week of the period) will advance to the final week of voting. The final week of voting will begin on 12:00:01 AM ET on 4/1/07 and end at 11:59:59 PM ET on 4/7/07.

  7. PRIZES & APPROXIMATE RETAIL VALUE: (1) Grand Prize - One (1) Grand Prize winner will be awarded a $75,000 check to participate in the recording of a Chock full o'Nuts radio commercial (only the Grand Prize winner will participate in the recording). Winner may also be asked to travel to a location determined by Sponsor to participate in the recording of a Chock full o' Nuts radio commercial. If winner is a group, one check in the amount of $75,000 will be awarded to one member of the group to distribute. The approximate retail value ("ARV") of this Grand Prize is $75,000.
  8. GENERAL TERMS: Unless at the sole discretion of Sponsor, no substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value. Void in AK, HI and where prohibited or restricted by law. Prize recipient will be solely responsible for paying all applicable federal, state and local taxes on prizes. No groups, clubs or organizations may reproduce or distribute any portion of these Official Rules to its members. In the event of a dispute as to winner's identity, entries will be deemed made by the Authorized Account Holder of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
  9. WINNER NOTIFICATION/RELEASES: All potential winners will be notified by phone, as indicated in the on-line entry. It is the responsibility of the winner to notify Sponsor of any changes in phone, mail, or email address information. If prize notification is returned to Sponsor or its designee as undeliverable without a forwarding address, the prize may be forfeited and an alternate winner may be selected at Sponsor's sole discretion. Any portion of any prize not accepted by winner shall be forfeited. If applicable, allow 4 to 6 weeks after recording is completed for delivery of prize following completion of notification process. Prizes will only be delivered to addresses within the United States. Potential Grand Prize Winner will be required to produce proof of identity, address, and birth date, as well as sign, notarize and return an affidavit of eligibility/release of liability and (except where prohibited) a publicity release (subject to verification) within seven (7) days of date of issuance. Failure to return all required documents within the time stated will result in the forfeiture of the prize and an alternate winner will be selected via a random drawing from all eligible entries received. Where permitted by law, you hereby give permission to Sponsor, Circle One Marketing, their respective parents, subsidiaries, divisions, affiliates, distributors, suppliers and advertising, and the employees, officers, directors and shareholders of each, to use, reproduce, exhibit, display, print, distribute, publish and broadcast, without any obligation to compensate you, your name, city/state, picture, portrait, likeness, voice, biography, and winner's statement, contained in, or relating to, your entry in the Contest in any and all advertising marketing and promotional materials, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web, except where prohibited by law, and without notice, approval, or review by you. Prizes are non-transferable and no substitutions or exchanges or cash equivalents will be allowed except at the sole discretion of the Sponsor. All winners, by acceptance of a prize, agree to release Releasees from any and all liability for, or relating to, any and all claims or actions of any kind whatsoever that you may have, or that may arise, against any of the Releasees for any matter or cause whatsoever, including without limitation, any injuries, damages or losses of any kind, whether direct or compensatory, incidental, consequential or otherwise to any person, including death and property damage, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, your participation in any Contest related activity, or your participation in the Contest. Releasees make no representations or warranties of any kind concerning the appearance, performance or safety of any prize awarded. All travel and transportation costs, if any, associated with collecting the prize are the responsibility of winner.

DISPUTES: Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any class action, and any judicial proceeding shall take place in a federal or state court within the state of New York; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorney fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the state of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the state of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the state of New York. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein.

    3. PRIZES & APPROXIMATE RETAIL VALUES ("ARV"): (1) Grand Prize - One (1) Grand Prize winner will be awarded a trip for two (2) people to New York City. Travel companions under 18 must be accompanied by their parent/legal guardian. The Grand Prize shall consist of a two (2) day, one (1)-night trip for two (2) people to New York City. If the winner lives more than 100 miles from New York City, Grand Prize includes round-trip ("R/T") coach class airfare (via an airline carrier selected by Sponsor) between the major U.S. gateway city airport closest to the winner's home and New York City, one (1) night accommodations (one (1) standard room, double occupancy) at a hotel selected by Sponsor (based on hotel availability) and two (2) tickets to a live concert performance at Radio City Music Hall. The approximate retail value ("ARV") of this Grand Prize is $3,500. At the sole discretion of Sponsor, winner may be permitted to choose a cash-out option of $3,500 in lieu of Grand Prize trip. If the winner lives 100 miles or less from New York City, the Grand Prize may include R/T ground transportation selected by the Sponsor, between the winner's residence and the hotel, in lieu of airfare, one (1) consecutive nights accommodations (one (1) standard room, double occupancy) at a hotel selected by Sponsor (based on hotel availability) and two (2) tickets to a live concert performance at Radio City Music Hall. The approximate retail value ("ARV") of this Grand Prize is $2,000. At the sole discretion of Sponsor, winner may be permitted to choose a cash-out option of $2,000 in lieu of Grand Prize trip. NOTE: all meals, incidentals, gratuities, telephone calls, and personal expenses incurred by a winner and his or her guest during their stay and any other expenses not specified herein are the sole responsibility of the winner and his or her travel companion. Winner and their travel companion will be responsible for all R/T ground transportation to and from the airport at the point of origin and destination. Hotel accommodations consist of room and room tax charges only. Grand Prize winner and his or her travel companion must travel on the identical itinerary. Travel must originate from and end at the same airport. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from the stopover point for the remaining segments, including the return, of the trip. Winner and companion must be available to travel from 6/1/07 through 12/17/07. Other travel restrictions may apply. Grand Prize winner and his or her travel companion will be required to provide appropriate Federal or state government issued photo identification at time of travel. Travel will not be eligible for frequent flyer points or miles. Winner and his or her travel guest are solely responsible for determining and obtaining all necessary travel documents and other travel requirements. No changes will be made to travel details once any portion of travel arrangements have been made, except at Sponsor's sole discretion. Releasees are not responsible for changes in schedule of any element of the Grand Prize, and Releasees are not liable for any expenses incurred as a consequence of flight cancellation/delay.     4. ODDS OF WINNING: Odds of winning depend on the number of entries from among all entry methods. Limit one prize per family/household.

    5. DRAWING: The drawing will be conducted via random drawing on or about 4/16/07 from among all eligible entries received through 11:59:59 p.m. (EST) on 3/31/07. Drawings will be conducted by a representative of Strobe Promotions, Inc. ("administrator"). All decisions of the Strobe Promotions representative shall be final. Potential winners will be contacted by phone.
